Terms of service

Terms of Service

These Terms govern your use of soapcouch.com and every order you place with us.

1. About these Terms

  • Who we are. SoapCouch is a brand of US To Future LLC ("SoapCouch," "we," "us"). These Terms are a contract between you and US To Future LLC.
  • Agreement. By using soapcouch.com (the "Site") or placing an order, you agree to these Terms and to our Return & Refund Policy, Shipping Policy and Privacy Policy, which are part of these Terms. If you don't agree, don't use the Site.
  • Eligibility. You must be at least 18, or the age of majority where you live, to place an order. If you're younger, a parent or guardian must place the order and accept these Terms.
  • Changes. We may update these Terms at any time by posting a new version here with a new date. An order is governed by the Terms in effect when it was placed.

2. Orders, pricing and payment

  • Prices. Prices are in US dollars and may change at any time. The price shown when you place your order is the price you pay.
  • Order acceptance. Your order is an offer to buy. Our confirmation email means we received it; the sale is final when we ship. We may refuse, cancel or limit any order, including limits per person, household or address, for example because of suspected fraud, resale or an error. If we cancel an order you've paid for, we refund it in full.
  • Errors. If a product is listed at the wrong price or with wrong information because of an error, we may cancel orders for it, even after confirmation, and refund you.
  • Payment. You authorize us and our payment processors to charge your payment method for your order total, including taxes and shipping. You confirm you're authorized to use that payment method.
  • Promotions and bundles. Promotions, discount codes and bundle prices apply only as described, can't be combined unless stated, have no cash value, and may change or end at any time unless an end date is stated. "Free" items in a bundle are part of the bundle price.
  • Payment disputes. Please contact us before disputing a charge with your bank so we can fix the problem. If you file a dispute, we may share your order details, delivery confirmation and these Terms with the payment processor, and we may decline future orders.

3. Shipping, title and risk of loss

  • Where we ship. We currently ship to US addresses only.
  • Delivery times. Delivery dates shown on the Site are estimates, not guarantees. We aren't responsible for carrier delays.
  • Your address. You're responsible for entering a correct shipping address. If a package is returned to us because the address was wrong or incomplete, we'll reship it at your cost.
  • Title and risk of loss. To the extent permitted by law, title and risk of loss pass to you when we hand your order to the carrier. This doesn't change our Return & Refund Policy for items that arrive damaged.
  • Delivered packages. Once tracking shows a package as delivered, we aren't responsible for its loss or theft. We'll help you file a claim with the carrier.

4. Returns, product information and warranty

  • Returns. Returns and refunds are governed by our Return & Refund Policy.
  • Natural wood. Each dish is cut from solid pine and finished by hand. Grain, color, knots and exact dimensions vary slightly from piece to piece and from the photos, and pine darkens with use. These variations are not defects.
  • Use and care. Our products are made to hold bar soap. Follow the care instructions on the Site. How long your soap lasts depends on your soap, water and use, and we don't guarantee specific results.
  • Ratings and order counts. Unless we say otherwise, ratings and order counts shown on the Site (such as "5.0 on Google" and "4,000+ orders") refer to all products sold by US To Future LLC, not only SoapCouch products.
  • Limited warranty. We warrant that our products are free from manufacturing defects (cracks, splits or flaws in the wood present at delivery) for 7 days after delivery. Your remedy is a replacement or refund under our Return & Refund Policy. This warranty doesn't cover normal wear, darkening of the wood, or damage from soaking, dishwashers, misuse or modification.
  • Disclaimer. Except for the limited warranty above, and to the fullest extent permitted by law, we make no other warranties, express or implied. Any implied warranties, including merchantability and fitness for a particular purpose, are limited in duration to the 7-day warranty period. The Site and its content are provided "as is" and "as available." Some states don't allow limits on how long an implied warranty lasts, so this limit may not apply to you. This warranty gives you specific legal rights, and you may have other rights that vary by state.

5. Limitation of liability and indemnification

  • No indirect damages. To the fullest extent permitted by law, we aren't liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits or data, arising from the Site, our products or these Terms, even if we were told they were possible.
  • Cap. Our total liability for any claim is limited to the amount you paid for the product that gave rise to the claim.
  • Limits of these limits. Some states don't allow these exclusions or limits, so they apply to you only as far as the law allows. Nothing in these Terms limits liability that can't legally be limited, such as for gross negligence or willful misconduct.
  • Indemnification. You agree to indemnify and hold harmless US To Future LLC and its owners, employees and agents from any claims, losses and costs (including reasonable attorneys' fees) arising from your misuse of our products or the Site, content you submit, or your violation of these Terms or the law.

6. Reviews, your content, and email and texts

  • Your content. When you submit a review, photo, video or other content, you confirm it's your own, truthful, based on your real experience, and doesn't violate anyone's rights.
  • License to us. You grant us a worldwide, royalty-free, perpetual, non-exclusive license to use, copy, display, share and adapt your content in any media, including advertising, with your first name and last initial. We may edit it for length or format but won't change its meaning.
  • Moderation. We may decline or remove content that is spam, off-topic, obscene, hateful, infringing, contains personal information, or is about a different product. We don't remove or hide reviews because they're negative, and any incentive we offer for a review never depends on the review being positive.
  • Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
  • Email and texts. If you sign up for marketing emails or texts, you agree to receive them. Unsubscribe from emails with the link in any email; stop texts by replying STOP, or reply HELP for help. Message frequency varies, message and data rates may apply, and consent isn't a condition of purchase. We'll still send order-related messages such as confirmations and shipping updates.

7. Acceptable use, intellectual property, third parties and privacy

  • Acceptable use. Don't use the Site for anything unlawful; scrape or harvest it with bots; interfere with its security or upload malicious code; place fraudulent orders or impersonate anyone; or buy products for commercial resale without our written permission.
  • Enforcement. We may suspend access, cancel orders or refuse service to anyone who violates these Terms.
  • Intellectual property. The Site and its content, including text, photos, graphics, logos and the SoapCouch name, belong to US To Future LLC or its licensors and are protected by intellectual property laws. You may not copy, reproduce, sell or otherwise use them without our written permission, except to browse the Site and buy products for personal use.
  • Third parties. Payments are processed by Shopify and our payment partners under their own terms. Links to other websites are provided for convenience; we aren't responsible for their content or practices.
  • Privacy. Our Privacy Policy explains how we collect and use your information.

8. Disputes: arbitration and class action waiver

  • Talk to us first. Before starting any claim, email us your name, order number, a description of the dispute and what you want. We'll both try in good faith to resolve it for 30 days.
  • Binding individual arbitration. If we can't resolve it, you and we agree that any dispute arising from these Terms, the Site or our products will be resolved by binding individual arbitration, not in court. Arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and fee schedule, under which the business pays most of the arbitration costs. One arbitrator decides. Hearings may be held by video, phone, written submissions, or in the county where you live. The Federal Arbitration Act governs this Section 8.
  • Exceptions. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may ask a court to stop infringement or misuse of intellectual property.
  • No class actions. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and the arbitrator may not combine claims of more than one person. If this waiver is found unenforceable for a claim, that claim must be decided in court, not in arbitration.
  • Jury waiver. If a claim proceeds in court, you and we waive any right to a jury trial, to the extent permitted by law.
  • Mass filings. If 25 or more similar arbitration demands are filed by or with the help of the same or coordinated counsel, they'll be administered under the AAA's Mass Arbitration Supplementary Rules.
  • Opt out. You can opt out of this Section 8 within 30 days of your first order by emailing us with the subject "Arbitration Opt-Out" and your name, address and order number. Opting out doesn't affect the rest of these Terms.
  • Time limit. To the extent permitted by law, any claim must be brought within one year after it arises.

9. Governing law and general terms

  • Governing law. These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs Section 8. Any court case allowed under these Terms will be brought in the state or federal courts located in Monroe County, New York.
  • Your rights. Nothing in these Terms limits rights you have under laws that can't be waived by contract.
  • Events beyond our control. We aren't liable for delays or failures caused by events beyond our reasonable control, such as severe weather, natural disasters, carrier or supply disruptions, labor disputes, internet outages or government action.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect (subject to the class action rule in Section 8).
  • Entire agreement. These Terms and the policies they reference are the entire agreement between you and us about the Site and your orders.
  • No waiver. If we don't enforce a provision, we haven't waived our right to enforce it later.
  • Assignment. We may transfer our rights and obligations under these Terms. You may not transfer yours without our written consent.
  • Electronic notices. You agree to receive notices from us electronically, including by email and by posting on the Site.
  • Survival. Sections 4 through 9 continue to apply after your order is complete or your use of the Site ends.
